Retrospective claim for nursing home fees wrongly paid won by west Sussex based consultancy
Just Care Consultancy Ltd have recently won a Continuing Healthcare claim for reimbursement of nursing home fees for one of their clients.
The claim was won on behalf of a client whose mother was in a nursing home in Sussex from 2004-2009. Just Care proved she should have been funded by the NHS and her family have just received a repayment of £222, 519.59. Many other people are paying for care that should be paid for by NHS funding.
Karen Grainger and Sarah Heselgrave left the Continuing Healthcare department at NHS West Sussex 18 months ago to concentrate full time on their company Just Care Consultancy Ltd.
“People thought we were mad to leave the NHS but we knew that people who have to pay for their care are often overlooked and are left with little or no structured resources to help them. Those who self fund their care can be paying tens of thousands of pounds a year, yet receive the least advice, the least monitoring and little or no review of their care. We wanted to change that and given the current cutbacks in health and social care our business is set to grow in a big way as the expectation is that more people will have to pay for their care”
However under NHS Continuing Healthcare funding people may get their fees paid if they meet the right criteria. Just Care Consultancy Ltd work with solicitors, families and individuals to ensure that those who should not be paying for their care receive the best chance of getting NHS funding:
Continuing Healthcare: Current eligibility and Retrospective Appeals:
Just Care support claims for NHS funding under Continuing Healthcare whether this is for current eligibility or retrospective appeals which can be paid even after people have died. This is a complex and frustrating system to navigate especially now that PCT’s are cutting their budgets and many people remain unaware that their relatives could be funded in this way.
In the past year they have:
• Won a Retrospective Case worth £222,519.59 to claimant
• Represented a family whose mother had her Continuing Healthcare funding withdrawn as the PCT said she no longer met the criteria but won the case so they did not have to sell the family home
• Represented a gentleman whose wife is in long term care. She was awarded funding both currently and for a retrospective claim
• Represented a solicitor whose mother died during the application process but was awarded retrospective funding
They know there are many other people out there who should be receiving funding for their care fees but are unaware of this fact or give up because of the frustrating system. PCT’s are cutting their budgets and are making it much more difficult for people to obtain funding.
